Customer: The person(s) buying the goods

Goods: All goods and services sold by the Supplier.

Price: Supplier reserves the right to change the price at their discretion

Carrier: Freight company of the suppliers choosing.

Acceptance:

The Customer agrees with all the Suppliers terms and conditions on purchase and payment of goods.

Customer Information: The Customer is responsible for ensuring correct and up to date names, contact  and address details are provided on all payment forms.

Payment:

Supplier accepts bank deposit, Visa, Mastercard, Paypal, Afterpay and Zip.

We do not store any payment or client details.

Bank deposit payments must be paid within 2 working days.

Goods:

Weights and dimensions of goods and cartons are approximates only and always as accurate as possible. Some goods may vary slightly from images.

Goods must be paid for in full by one payment method only before despatch.

All prices include GST and are in Australian dollars

Delivery Fees:

Delivery fees and times vary for different products and are calculated based on the size and weight of your order and its destination.

The delivery price for each order will be displayed during the checkout process, prior to payment and order confirmation and included in the total price of your order.

Changes made to delivery address or delivery time after placing an order may incur additional charges, which we reserve the right to request to add to your original delivery charge.

Delivery of Goods:

The Supplier will despatch the goods in a timely manner usually within 2 business days.

Tracking will be sent to clients email address once scanned by the freight company.

The goods will be left with authority to leave (unless requested not to be left) at the customers risk.

Our freight company may leave a card at the address and you will need to pick up the delivery from a depot or contact the freight company to arrange for re-delivery. We do not charge a re-delivery fee.

The customer must give clear instruction for delivery and make sure access is available and safe for our delivery drivers.

The Customer must be available to accept delivery if authority to leave is not given where possible.

Delivery instructions requested by the customer will be passed on to the freight company, but can not be guaranteed.

Goods that come in more than one carton or multiple goods may arrive on different day and by different carriers.

If you live in a rural area, you may be required to collect your order from a local depot or collection point.

We CANNOT deliver:

  • Outside of Australia
  • To PO boxes or post offices
  • To South Nanango 4615, Laguna 2325 or Putty 2330 (Additional charges may apply.)
  • To any islands without road access. This includes (but is not limited to) King Island 7256 and Russell Island 4184.

Warranty:

Consumer guarantees apply under Australian Consumer Law.

Unfortunately, sometimes things get damaged in transit. Any problems must be advised within 14 days of receipt of the goods.

Please email us (info@somerzby.com.auwithin 14 days of receiving your order. Please include your order details plus photos clearly showing all damaged part(s) so we can identify them. You must also identify the damaged parts from the instruction sheet. This must be done before using, assembling or modifying the product.

We will replace any parts damaged in transit free of charge. This is at our discretion. If we offer replacement parts, you must confirm you want them sent within 10 days of receiving our offer.

Sometimes a partial refund may be offered instead of parts, at our option, if the product can be repaired easily by the customer. Prior approval is required.

If the customer refuses replacement parts then it is at their cost to return the goods for a refund less freight charges. Please note: if we arrange the return on your behalf, return freight is 2x the original freight charge.

We are not liable for damage caused in transit to orders collected from our warehouse. For orders placed through click and collect, any replacement parts required due to issues will need to be picked up from our warehouse.

We do not offer an extended warranty except those implied by Australian Consumer Law.

Jurisdiction: With your purchase you agree these terms are governed by the laws of New South Wales, Australia.  You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales and its appellate courts.  All disputes will be heard in Gosford, NSW.

Returns:

We are not obliged to accept returns for change of mind. However, we will accept change of mind returns for up to 15 days from purchase only.

You must obtain prior authorisation from us before returning goods. You must contact us before you assemble or use the product/s. Customers must provide relevant order/contact details before a refund can be actioned.

Products must be sent back unused and unassembled with no damage.

A refund less freight charges will be given. If we arrange return freight on your behalf, return freight is 2x the original freight charge.

If an order is cancelled after it has been dispatched, a refund less the original and associated return freight charges will be deducted from the refund amount.

A re-stocking fee may be charged at our discretion. For payments made via Afterpay, we will deduct the Afterpay fee from your refund amount.

Refunds will be in the same payment method as payment was received.

Risk:

Damage to the goods or property after delivery has been received is passed onto the customer.

Supplier does not accept liability for any loss, theft or damage to the products after delivery.

Customer agrees supplier has supplied goods in good faith in the safest and best condition.

Defects:

The customer agrees not to use the goods for any other reason than they are designed for.

Supplier is not liable for client failing to follow the instructions or advice

Supplier is not liable for any act of god, accident or fair wear and tear.

Our Liability:

To the extent permitted by law:

– We will not be liable for any loss of income, loss of profits, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by (negligence), breach of contract or otherwise.

– Our maximum aggregate liability for any goods supplied to the client whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to the supplier in respect of the Goods(s) in question.

Force Majeure:

We shall not be responsible for any delay, suspension or failure arising out of any circumstances outside of our reasonable control, including but not limited to, acts of God, governmental actions, shipping, postal or other relevant transport strike, postal theft, failure or accident, lockouts or other labour difficulty, war or national emergency, acts of terrorism, fire, explosion, flood, an act or omission of a third party, inability to obtain any necessary materials, equipment, facilities or services, the failure of performance provided by others, interruption of the internet or a website (such as Facebook) or virus, accidents or breakdown of plant, machinery, software, hardware or communication network.

Free Promotional Items:

Occasionally we give away free items when you purchase selected enclosures. There is strictly one free item per order only. Free items may be substituted with another item if stock runs out. Free item must be selected at time of order.

Click and Collect Pick-up Service:

Our Click and Collect service allows customers to make their purchases online and then pick them up directly from our warehouse on the Central Coast, NSW. To use the Click and Collect service, you must order and pay for your items through our website then book in a time for warehouse pick up.

Please note that we do NOT have a showroom. Our warehouse is only available for the collection of pre-purchased items. We do NOT allow pickups without an online purchase.

You can book your pickup Monday – Friday between 9:00am – 1:00pm. You must arrive within your booked time slot. If you are no longer able to pick up within your booked time slot, please call to rearrange a time ASAP. No-shows may be charged a fee.

When you pull into the driveway, please park in the Customer Parking on the left-hand side. Come to the reception front desk first. Do NOT enter the warehouse. You will need to present our staff with your order number and valid photo ID.

Please ensure you have a vehicle large enough to pick up your order. Carton dimensions can be found at the bottom of each product page. If you have a ute or trailer, you will need to bring your own tie-downs.

If you have paid via bank transfer, you cannot pick up your order until payment has cleared. This can take up to 3 business days depending on your bank. If you are unsure your payment will clear before your booked pick up time, please call us to confirm.
